For the tax credit program, the IRS defines a first-time home buyer as someone who has not owned a principal residence during the three-year period prior to the purchase.&lt;/li&gt;&lt;li&gt;The tax credit does not have to be repaid. &lt;/li&gt;&lt;li&gt;The tax credit is equal to 10 percent of the home’s purchase price up to a maximum of $8,000. &lt;/li&gt;&lt;li&gt;The tax credit applies only to homes priced at $800,000 or less. &lt;/li&gt;&lt;li&gt;The tax credit now applies to sales occurring on or after January 1, 2009 and on or before April 30, 2010. However, in cases where a binding sales contract is signed by April 30, 2010, a home purchase completed by June 30, 2010 will qualify. &lt;/li&gt;&lt;li&gt;For homes purchased on or after January 1, 2009 and on or before November 6, 2009, the income limits are $75,000 for single taxpayers and $150,000 for married couples filing jointly. &lt;/li&gt;&lt;/ol&gt;For homes purchased after November 6, 2009 and on or before April 30, 2010, single taxpayers with incomes up to $125,000 and married couples with incomes up to $225,000 qualify for the full tax credit.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The $6,500 Move-Up / Repeat Home Buyer Tax Credit at a Glance&lt;ol&gt;&lt;li&gt;To be eligible to claim the tax credit, buyers must have owned and lived in their previous home for five consecutive years out of the last eight years. &lt;/li&gt;&lt;li&gt;The tax credit does not have to be repaid. &lt;/li&gt;&lt;li&gt;The tax credit is equal to 10 percent of the home’s purchase price up to a maximum of $6,500. &lt;/li&gt;&lt;li&gt;The tax credit applies only to homes priced at $800,000 or less. &lt;/li&gt;&lt;li&gt;The credit is available for homes purchased after November 6, 2009 and on or before April 30, 2010.  &lt;p&gt;&lt;span style="font-family: Arial;"&gt;Pending Home Sales maintained their uptrend in August. NAR’s pending home sales index posted a reading of 103.8 for the month – a 6.4% increase from July’s 97.6 and 12.4% above the reading in August of 2008. August’s pending home sales index is the highest index since March of 2007 and the seventh consecutive month in which the index rose. On both a month to month and year over year basis, pending sales were up in every region of the country.   &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;h3&gt;&lt;span style="font-family: Arial;"&gt;Existing-Home Sales&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/h3&gt;  &lt;p&gt;&lt;span style="font-family: Arial;"&gt;Existing-home sales slipped 2.7% in August to a seasonally adjusted annual rate of 5.10 million units – 3.4% above their ales level in August of 2008. The national median sales price for n existing home was $177,700. The inventory of existing homes available for sale at the end of August fell to 3.62 million units – an 8.5-month supply at the current sales pace. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;h3&gt;&lt;span style="font-family: Arial;"&gt;New-Home Sales&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/h3&gt;  &lt;p&gt;&lt;span style="font-family: Arial;"&gt;New home sales rose slightly in August, posting a seasonally adjusted annual rate of 429,000 units – 0.7% ahead of July’s revised rate of 426,000. New home inventory continued to decline to a 7.3 month supply at the current sales rate. That is down 3.9% from the previous month and more than 34% off its year-ago level&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;h3&gt;&lt;span style="font-family: Arial;"&gt;Housing Starts&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/h3&gt;  &lt;p&gt;&lt;span style="font-family: Arial;"&gt;Housing starts also posted a small increase in August, registering 598,000 units – up 1.5% from July’s level of 589,000. Despite the rise in August, starts were still 29.6% below their level a year ago. Building permits – generally a reliable indicator of future starts – posted a seasonally adjusted annual rate of 579,000 – 2.7% above July’s level. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;h3&gt;&lt;span style="font-family: Arial;"&gt;Housing Affordability&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/h3&gt;  &lt;p&gt;&lt;span style="font-family: Arial;"&gt;Housing affordability continued at very healthy levels. NAR’s Housing Affordability Index (HAI) posted a reading of 159.1 in August – up from July’s reading of 155.5 and significantly higher than the 125.8 reading in August of 2008. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;h3&gt;&lt;span style="font-family: Arial;"&gt;Mortgage Rates&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/h3&gt;  &lt;p&gt;&lt;span style="font-family: Arial;"&gt;Mortgage rates declined in September. The average 30-year fixed mortgage rate for the month was 5.06%, down from the average 5.19% in August and almost a full percentage point lower than in September of 2008. While slight upticks are possible, interest rates are expected to remain exceptionally low throughout the rest of this year. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;h3&gt;&lt;span style="font-family: Arial;"&gt;Employment&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/h3&gt;  &lt;p style="margin-bottom: 12pt;"&gt;&lt;span style="font-family: Arial;"&gt;The economy shed 263,000 jobs in September – a larger number than anticipated and a sign that despite other encouraging figures on the economy, the job market remains a drag on a more robust economic recovery. The unemployment rate rose to 9.8% – its highest level since June of 1983.&lt;br /&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;h3&gt;&lt;span style="font-family: Arial;"&gt;Economic Growth&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/h3&gt;  &lt;p&gt;The &lt;st1:place st="on"&gt;&lt;st1:country-region st="on"&gt;U.S.&lt;/st1:country-region&gt;&lt;/st1:place&gt; economy showed some improvement in the 2nd quarter of this year. Guest families are sheltered overnight in area churches and receive hospitality from church members/volunteers. But the state's urban employers are hungry for educated,  skilled workers. Alaska's tourism industry has been hit but its military bases,  hospitals, and oil industry have stayed strong.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoNormal" style="margin-bottom: 9pt; margin-left: 6pt; line-height: 121%; margin-right: 6pt;"&gt;&lt;span style="font-size: 9pt; color: rgb(51, 51, 51); line-height: 121%; font-family: 'Arial','sans-serif';"&gt;"The  probability of getting a job, depending on your qualifications, is probably  relatively high here," says Scott Goldsmith, professor of economics at the  University of Alaska Anchorage. This past week in Mexico was amazing.&lt;br /&gt;I had the privilege of leading a team of 15 to Mexico for the past week. Our goal was to build homes for those in need. Our amazing team ranged in age from 13 to 27.&lt;br /&gt;We ended up flying to San Diego then driving to our site in Mexico. We literally camped out for the week as we built the homes. Our team of mostly teenagers did absolutely amazing. It was awesome to see them sit up and take responsibility when they saw the real need in this world. They worked hard and we had a lot of fun getting out butts whooped in soccer by the Mexican children.&lt;/div&gt;&lt;br /&gt;&lt;br /&gt;&lt;div&gt;&lt;br /&gt;Our week was very successful. We were able to build two homes in the time it takes most teams to finish one. Part of my job as Chairman is staying in touch with what happens here locally and what happens in Washington.&lt;br /&gt;This article was sent to me and I thought it did a great job of explaining the $8,000 tax credit and wanted to get it to you. &lt;/p&gt;&lt;p&gt;&lt;br /&gt;Please know you can call me any time if you have questions about our market locally and nationally. &lt;/p&gt;&lt;p&gt;&lt;br /&gt;You are my friends and clients, my family and I appreciate you!&lt;br /&gt;-&lt;br /&gt;The $8,000 tax credit and what it means to you.&lt;br /&gt;&lt;br /&gt;The $8,000 tax credit is included in the $787 Billion (yes, with a B) stimulus plan with various tax cuts and spending programs.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;Part of the stimulus included a revision to last year's repayable tax credit to an $8,000 tax credit that does NOT need to be repaid.&lt;br /&gt;Be advised, not all tax preparers are aware of all of the provisions of the new tax credit. I had a client call me from Jackson Hewett saying they would not apply the $8,000 tax credit for a house she purchased in 2009 to her 2008 tax year. This is not correct, see When Can the Credit be Claimed below.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;So here's a breakdown of the new $8,000 tax credit:&lt;br /&gt;All first-time homebuyers who purchase a home between January 1, 2009 and November 30, 2009 may be eligible for a tax credit of $8,000 or 10% of the purchase price, whichever is lower. Unlike its $7,500 predecessor, the $8,000 does not need to be repaid.&lt;br /&gt;Tax Credit vs. Tax Deduction&lt;/p&gt;&lt;p&gt;&lt;br /&gt;This is a tax credit, not a tax deduction, meaning it’s a dollar-for-dollar decrease to your tax liability. Also, the tax credit is refundable, meaning you can receive the full value of the credit even if you do not have an $8,000 tax liability.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;Phase-Out&lt;br /&gt;The tax credit phases-out for individuals making $75,000 or over modified adjusted gross income (MAGI), and couples making $150,000 or over MAGI. Below are examples of how the phase-out will apply to the two different scenarios.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;Individual Making $75,000 or Over&lt;br /&gt;Assume that an individual homebuyer has a modified adjusted gross income of $88,000. The buyer’s income exceeds $75,000 by $13,000. Dividing $13,000 by $20,000 yields 0.65. When you subtract 0.65 from 1.0, the result is 0.35. Multiplying $8,000 by 0.35 shows that the buyer is eligible for a partial tax credit of $2,800.&lt;br /&gt;Couple Making $150,000 or Over&lt;/p&gt;&lt;p&gt;&lt;br /&gt;Assume that a married couple has a modified adjusted gross income of $160,000. The applicable phase-out to qualify for the tax credit is $150,000, and the couple is $10,000 over this amount. Dividing $10,000 by $20,000 yields 0.5. When you subtract 0.5 from 1.0, the result is 0.5. To determine the amount of the partial first-time homebuyer tax credit that is available to this couple, multiply $8,000 by 0.5. The result is $4,000.&lt;br /&gt;I'm not sure of the $20,000 significance, other than it's defined as the factor to use on &lt;a href="http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=110_cong_bills&amp;amp;docid=f:h3221eah2.txt.pdf"&gt;pgs. 615-616 of HR 3221&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Who Cannot Take the Tax Credit&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;br /&gt;If any of the following apply, you cannot take the tax credit:&lt;br /&gt;1. Individuals making $95,000 or over MAGI, and couples making $170,000 or over MAGI; meaning you receive no tax credit if your income is this much or more a year.&lt;br /&gt;2. You buy your home from a close relative, including: parent, sibling, spouse, grandparent, child, etc.&lt;br /&gt;3. You sell your home within the first three years of purchasing it. If this occurs, the tax credit must be repaid.&lt;br /&gt;4. You are a non-resident alien&lt;br /&gt;5. If home ceases to be your primary residence within first year of purchase. In other words, if you purchase a home in 2009, and move-out or sell in 2009, then you can't take the tax credit on your 2009 tax return. I'm assuming you are subject to recapture if you purchase the home in 2009, take the credit on your 2008 tax return, and move-out or sell in 2009.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;First-time Homebuyer Definition&lt;br /&gt;A first-time homebuyer is defined as someone who has not owned a home within the last three years. If married filing jointly, both spouses must meet the first-time homebuyer definition to take the tax credit.&lt;br /&gt;The bill states both spouses must be first-time homebuyers to qualify for the credit. There doesn't seem to be an exception to this rule if filing separately. However, I'd consult your tax preparer.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;Recapture Period&lt;br /&gt;If you dispose of the primary residence or it ceases to be your primary residence during the first three years of purchase, the tax credit is recaptured. In doing my research, there seems to be conflicting opinions on whether you're subject to recapture if the home "ceases" to be your primary residence during the first three years of purchase. The National Association of Realtors seems to believe recapture only &lt;a href="http://www.realtor.org/wps/wcm/connect/f6ee3f004d2465a491f6f526a9949436/government_affairs_homeb_tax_credit_new.pdf?MOD=AJPERES&amp;amp;CACHEID=f6ee3f004d2465a491f6f526a9949436"&gt;applies to &amp;amp; selling your home&lt;/a&gt;. However, it seems to me that moving out of the property within three years would also make you subject to recapture. I'd recommend reading the bill's verbiage for yourself (&lt;a href="http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=110_cong_bills&amp;amp;docid=f:h3221eah2.txt.pdf"&gt;carries over from HR 3221, pg 619&lt;/a&gt;) and consulting your tax preparer. The section reads:&lt;/p&gt;&lt;p&gt;&lt;br /&gt;ACCELERATION OF RECAPTURE.—If a taxpayer disposes of the principal residence with respect to which a credit was allowed under subsection (a) (or such residence ceases to be the principal residence of the taxpayer (and, if married, the taxpayer’s 20 spouse)) before the end of the recapture period.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;When Can the Tax Credit be Claimed?&lt;/p&gt;&lt;p&gt;&lt;br /&gt;The $8,000 tax credit can be claimed for your 2008 tax year (filed by April 15th 2009), 2008 amended return or 2009 tax year.&lt;br /&gt;Homes That Qualify&lt;/p&gt;&lt;p&gt;&lt;br /&gt;The tax credit is applicable to any home that will be used as a principle residence. Based on that guideline, qualifying homes include single-family detached homes, as well as attached homes such as townhouses and condominiums. In addition, manufactured or homes and houseboats used for principle residence also qualify. For new construction, the purchase date is considered the day you occupy the home; therefore you must move-in by November 30th 2009 to qualify for the tax credit.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;Also, homes in the District of Columbia qualify for the tax credit. We are lucky to be Alaskans, since winter has its own set of adventures that we can look forward to.&lt;br /&gt;&lt;br /&gt;The contrast in temperature was unmistakable several weeks ago when I traveled to Austin Texas for Real Estate training. I was clutching my Aquafina for dear life, and praying that each up and coming water fountain wasn’t going to fizzle into a heat mirage. 90+ temperatures squelched my complaints about the cool summer we’ve had up here…it could be worse.&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;&lt;div&gt;Keller Williams Mega Camp was absolutely phenomenal. I had the privilege of being taught by John Maxwell and meeting him. I gleaned a lot of valuable insight from many other great leaders in the industry.&lt;br /&gt;&lt;br /&gt;The main focus of the event was the current state of our market, and how to get through the slump! Time seems to have disappeared with the sun these last few months. I feel as though I blinked and missed most of it! Below I have captioned a few things that I actually do remember happening, if for nothing else, to have literary record that there really was a summer 2008.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The Family&lt;/strong&gt;&lt;br /&gt;Life on the home front is full of much laughter and many tears. We have a 2 ½ year old, need I say more? I didn’t realize a human being was capable of such enormous and instantaneous mood swings! Yet, beneath all the tantrums and showers of kisses is a little boy I couldn’t love more. The youngest is equally wondrous, but a lot easier on the ears! He’s quiet, cuddly, and ridiculously good looking, which is probably why my wife swears he takes after her. Hanna ran her first ½ marathon this summer, started painting, and is busy with life in general. If I ever feel like pulling my hair out, I just spend a day or two doing what she does. I’m so glad she takes care of us boys. &lt;br /&gt;&lt;br /&gt;&lt;strong&gt;The Business&lt;br /&gt;&lt;/strong&gt;Thanks to you, this has been a good year so far. One of my great joys is receiving referrals from my past clients. Thank you for trusting me with your friends and family.&lt;br /&gt;This week I am heading to Texas for a week of training. I’ll be at an intensive Keller Williams Conference where I will be able to network and learn valuable information about our market and Real Estate. I want to be the kind of person who is always learning. It helps me, my business, and ultimately my clients and co-workers. My assistant will be here to hold down the fort while I’m gone. If any of you are interested in learning more about it, give me a call!&lt;br /&gt;&lt;strong&gt;The Market&lt;/strong&gt;&lt;br /&gt;Many of you have heard me say that the real estate market is not national- it’s local. So here are some of the local highlights:&lt;br /&gt;&lt;br /&gt;-We are the only state that has appreciated since the “peak” in 05!!!&lt;br /&gt;-Our Valley job growth of 3.9% is 3 times the national average.&lt;br /&gt;- In the state we created 1,700 jobs in the last 12 months 648 of those jobs are here in the valley.&lt;br /&gt;- Since 2002 our average property values have gone from $150,000 to $225,000.&lt;br /&gt;&lt;br /&gt;All that said, I won’t pretend that we don’t have many people struggling to get out of their homes. Those that struggle the most in this market are people who bought homes with “time bomb” loans and after their interest rates adjusted they could no longer afford their homes. Even though our home prices have increased in the last three years, there are a large number of homes on the market which makes it difficult to sell some certain homes without a loss. This year I have made it my goal to help as many people out of this situation as I can. I have been able to help people get out of their homes and not lose their shirts through “short sale”, “early payoffs”, and a lot of hard work. If you know some one in this position please let me know. It’s Saint Patrick’s Day as I sit down to right this. It’s a beautiful day and the hope of spring is in the air! I am so glad that I fell for an Alaskan woman. Days like this I love living in the Last Frontier. &lt;/p&gt;&lt;/w:wrap&gt;&lt;/v:imagedata&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;Everybody has a hierarchy in their life of the things that are important to them. For me, the three first things are God, Family, and business. Here are a few March highlights of each of those:&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;1) God&lt;/p&gt;&lt;p class="MsoNormal"&gt;This last month was amazing. I’ve really seen God provide for people this month. I was asked to lead a mission’s team of teenagers from my church to &lt;?xml:namespace prefix = st1 /&gt;&lt;st1:country-region st="on"&gt;&lt;st1:place st="on"&gt;Mexico&lt;/st1:place&gt;&lt;/st1:country-region&gt;. Three days before &lt;/p&gt;&lt;p class="MsoNormal"&gt;we were scheduled to leave we were several thousand dollars short of what we needed to make this trip a go. With in those 3 days, miraculously, money poured in from all sorts of places and we ended up having about $2,500 surplus which we will put toward the next trip. &lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;Our team had a lot of fun paying for and building a home for an impoverished family. We got to meet all the members of the family and build a relationship with them. It was really an amazing experience to bless complete strangers. The teens learned a lot about sacrifice and giving. She would have loved to get her fingers dirty with the rest of us, but someone had to look after our two little rascals. Hanna is busy getting in shape after the birth of our 2&lt;sup&gt;nd&lt;/sup&gt;. She’s lost about 40 pounds the last few months and is busy training for a half-marathon this summer. I have to say; when she beat me at arm wrestling I knew it was time to join the gym. We’ve started working out together and it’s been really fun.&lt;v:imagedata title="pics 001" src="file:///C:\DOCUME~1\WAYNES~1\LOCALS~1\Temp\msohtml1\01\clip_image011.jpg"&gt;&lt;w:wrap type="square"&gt;&lt;/p&gt;&lt;/w:wrap&gt;&lt;/v:imagedata&gt;&lt;p class="MsoNormal"&gt;March is also our anniversary month. It’s been five years, and I love her even more now than the day I married her.&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;Maddox is three months old now and is enough to melt your heart. He’s gotten really good at smiling and is right on the verge of breaking into laughter. You should see his fat little legs.&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;v:imagedata title="pics 004" src="file:///C:\DOCUME~1\WAYNES~1\LOCALS~1\Temp\msohtml1\01\clip_image013.jpg"&gt;&lt;w:wrap type="tight"&gt;Gideon is busy as ever. His new thing is wearing Hanna’s high heels. I must have looked a little worried the other day because Hanna started assuring me he was just copying her and doesn’t know the difference between women’s and men’s shoes yet! Oh, the anxieties of a new father!&lt;/p&gt;&lt;/w:wrap&gt;&lt;/v:imagedata&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;3) Business&lt;/p&gt;&lt;p class="MsoNormal"&gt;Although this winter the Real Estate market has stayed fairly steady around here, this month I’ve seen the pace pick up. Spring is in the air, and people seem to respond to that. We aren’t seeing as many new homes built at this time as we were a year ago, which is allowing some of the existing homes to have a better chance of selling. With the headlines all over the world, people seem fearful of the current market. I believe however, that the majority of homes, if priced right and presented well, will sell. I’m working hard, and seeing steady results. Lastly thank you again for all your referrals.
